Social Media Association, Inc. may make mobile device applications and/or mobile marketing campaigns available to you, and may allow you to register for services that involve e-mails, text messages, and other communications to be sent to your mobile device. In that event, you will be responsible to obtain access to the mobile device services.  You may incur third party fees, including mobile carrier and/or airtime charges, for such access, over which we have neither knowledge nor control. You are solely responsible for those fees, including fees associated with the use of the applications and delivery of e-mails, text messages, and other communications sent to your mobile device. You should consult your mobile service provider’s pricing plan prior to purchasing or downloading any application or registering for any such service to determine the charges for sending or receiving emails, text messages, and other communications to your mobile device.  You will be given the opportunity to “opt-out” of receiving emails, text messages, and other communications sent to your mobile device.

Risks

Social Media Association, Inc. strives to protect the personal information and privacy of each user.  However, we cannot assure the security of any information you disclose online, and you do so at your own risk.  You acknowledge that you are aware of security and privacy limitations including but not limited to: (1) the global accessibility of the Site on the Internet; (2) the limitation of security, privacy, and authentication measures and features in this system; (3) that data or information on the website may be subject to eavesdropping, sniffing, spoofing, forgery, spamming, “impostering”, tampering, breaking passwords, harassment, fraud, electronic, trespassing, hacking, nuking, system contamination (including, without limitation, viruses, worms, and Trojan horses) causing unauthorized, damaging, or harmful access and/or retrieval of information; and (4) the risk that data on your computer may be subject to other security or privacy hazards or may not reach its destination or may reach an erroneous address or recipient.

Children

Social Media Association, Inc. is committed to the safety of children and to protecting the online privacy of children.  Children under eighteen (18) may not use this Site.  Social Media Association, Inc. will not request or knowingly collect from a child any personal information about the child or child’s family.  Social Media Association, Inc. is not able to prohibit minors from visiting this Site.  Social Media Association, Inc. relies on parents, guardians, and those responsible for supervising children under the age of eighteen (18) to decide whether this Site is appropriate for children to view or use.

General Legal Terms

You and Social Media Association, Inc. have agreed to this Policy within the State of New York, for all purposes.  All services that are furnished to you on (or through) the Site are deemed to be furnished within the State of New York.  All such services are being furnished by Social Media Association, Inc. through its personnel and computer equipment located within the State of New York.

All disputes arising out of, under, or in connection with this Policy (including without limitation, their validity, interpretation, performance, or breach) will be adjudicated exclusively in the federal or state courts located in  (or having jurisdiction over) Nassau County, New York.  You expressly consent to the jurisdiction of such courts over you.  You expressly waive any claim of forum non conveniens.  You agree to reimburse Social Media Association, Inc. for its legal fees and expenses of instituting (or defending) a lawsuit by (or against) you.  This Policy and its validity and effect will be interpreted under, and governed by, the laws of New York, without regard to its conflict of laws provisions.

This Policy (and any other operating rules or terms posted on the Site (including, without limitation, the Terms of Service)) constitute the entire agreement between Social Media Association, Inc. and you, and supersede all previous written or oral agreements between Social Media Association, Inc. and you.  No action (or inaction) by Social Media Association, Inc. may be construed as a waiver of this Policy (or any part).  If any of the provisions of this Policy are held to be unenforceable by a court having competent jurisdiction, the remainder of this Policy will continue in full force and effect.

Law Enforcement

Social Media Association, Inc. fully cooperates with law enforcement agencies in identifying those who use our services for illegal activities.  Social Media Association, Inc. reserves the right to release information to law enforcement agencies about users who Social Media Association, Inc. believes are in violation of this Policy.  Social Media Association, Inc. also reserves the right to report to law enforcement agencies any activities that Social Media Association, Inc. believes to be unlawful and the identity of those who may be responsible.
